Terms

The terms of using NicoCares.

What you agree to when you use NicoCares, when you pay and for what, and the rights you keep.

Effective October 11, 2026.

About these terms

These terms are an agreement between you and NicoCares by Totality ("NicoCares", "we", "us"). They apply when you use nicocares.com, take the eligibility check, open an account or buy a plan. By doing any of those things you accept them. If you do not accept them, please do not use the service.

How we handle your information is set out in our privacy policy, and how you pay, renew, pause, cancel and get a refund in our payment and refund policy. Both form part of these terms.

What NicoCares is

NicoCares coordinates physician-guided weight care. It does not practice medicine and it is not a pharmacy. Independent physicians licensed in your state decide whether treatment is appropriate for you and what to prescribe, and licensed pharmacies fill those prescriptions. The physician's clinical judgment is theirs alone, and NicoCares does not direct it.

NicoCares is not an emergency service. If you think you are having a medical emergency, call 911 or go to the nearest emergency room.

Not medical advice

The articles and other content on this site are general information, not medical advice for you. The eligibility check is not a medical assessment; it tells a physician enough to decide whether to review you further. Individual results vary, and no particular outcome is promised.

Who can use NicoCares

  • You must be 18 or older and live in a state we serve. The eligibility check tells you if we do not serve yours.
  • You must give accurate, complete and current information about yourself, and keep it current. A physician relies on it to make decisions about your care.
  • You may use NicoCares only for yourself. Do not submit anyone else's information.

How it works, and when you pay

  1. The eligibility check. You can stop at any point, and your answers are not submitted for your eligibility check until you finish. If you are signed in, your answers so far are saved to your account as you go, so you can continue on another device, as the privacy policy describes. While you type your address, the text is looked up to suggest matches, as the privacy policy describes.
  2. Choosing a plan. If the check finds the program may suit you, you choose a plan and pay for it, once for its full length, on Stripe's secure checkout page. An active plan is required before your answers are reviewed and a physician is assigned.
  3. The medical intake. After you subscribe you complete a medical intake and upload a photo of a valid government-issued ID. The medical intake is required before the physician reviews you, and the ID is required before anything can be prescribed.
  4. Physician review. A physician licensed in your state reviews everything you gave us. They may ask you further questions, and they decide whether to prescribe. They may decide that treatment is not appropriate for you.
  5. Fulfillment. If a physician prescribes, the pharmacy you chose fills the prescription and it is delivered to the address you gave.

Your plan is billed once for its full length when you choose it, before the physician's review. Paying for a plan does not mean you will be prescribed anything. If a physician decides not to prescribe, nothing ships, and you can ask for a refund, as our payment and refund policy describes.

Plans, billing and cancellation

  • Plan terms. Before you pay, each plan shows its price, its length, how and when it is billed, what it includes and whether it renews. Those terms are part of this agreement, and where they differ from these terms, the plan's terms govern.
  • Payment. By choosing a plan you authorize us, through Stripe, to charge the payment method you give for the full amount that plan states at checkout, and for each renewal of the same length until you cancel. You commit to the full length of the plan you choose.
  • Price changes. We tell you before a price change applies to your plan, and you can cancel before it does.
  • Cancellation. You can cancel before the next billing date by emailing [email protected] from the address on your account. Cancelling stops the plan renewing, so no further charges are made. It does not refund a plan you have already paid for or medication that has already been dispensed, except as our payment and refund policy describes.
  • Billing questions. If you believe you were charged in error, email us and we will review the charge with you.

Nothing in this section limits a right to a refund or a cancellation that the law where you live gives you.

Prescriptions and your care

Follow the directions your physician and pharmacy give you. Tell your care team promptly about side effects, new medications or changes in your health, using the secure messaging in your account. A refill may depend on a check-in your physician reviews. Your physician may change or stop treatment when they judge it appropriate.

Your account

You sign in with a one-time code or link sent to your email address, so keeping that mailbox secure keeps your account secure. You are responsible for what happens in your account. Tell us straight away at [email protected] if you think someone else has accessed it.

Messages from us

By finishing the eligibility check you agree to receive emails and text messages from NicoCares about your account, your care and your orders. Message and data rates may apply. You can opt out of text messages at any time, though some messages about your care may then reach you only by email. We send marketing only if you asked for it, and every marketing email has an unsubscribe link.

Acceptable use

Do not:

  • submit false information, or anyone else's information as your own;
  • try to reach data or accounts that are not yours, or test or bypass the service's security;
  • interfere with the service, or use automated means to access it in bulk;
  • resell, share or redistribute a prescription or medication you receive through NicoCares; or
  • use the service in a way that breaks the law.

We may suspend or close an account that breaks these rules.

Content on this site

Some people, clinics and reviews shown on the site illustrate how the service works and are not real patients or practitioners. A physician named as a medical reviewer, with credentials, is a real person. The site's text, design, logos and images belong to NicoCares or its licensors. You may view and share them for personal, non-commercial use, and you may not copy or reuse them otherwise without our written permission.

Other companies' services

Payment is handled by Stripe, secure messaging by Spruce Health, and prescriptions by the pharmacy you choose. Each has its own terms and privacy practices, which apply when you use it.

Disclaimers

To the extent the law allows, the site and the service are provided "as is" and "as available". We do not promise that the site will always be available or free of errors. The medical care you receive is provided by independent physicians and pharmacies, who are responsible for it.

Limitation of liability

To the extent the law allows, NicoCares is not liable for indirect, incidental, special or consequential losses, or for lost profits or data, arising from your use of the service. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim arose. None of this limits liability that the law does not allow to be limited.

Governing law and disputes

These terms are governed by the laws of the State of South Carolina, without regard to its conflict-of-law rules. If a dispute arises, email us first and give us thirty days to try to resolve it. If we cannot, the dispute will be decided by the state or federal courts located in South Carolina, and you and we consent to their jurisdiction. Nothing in these terms takes away a protection that the consumer law of your own state gives you.

Changes to these terms

We may update these terms. When we do, we post the new version here and update its effective date. If a change is material, we email account holders before it takes effect. Using the service after a change takes effect means you accept it.

Ending your use

You can stop using NicoCares at any time; cancelling a plan is described above. We may suspend or end your access if you break these terms or if we stop offering the service in your state. The sections on billing, content, disclaimers, liability and governing law continue to apply after your use ends.

NicoCares coordinates care; it does not prescribe. A licensed physician decides whether treatment is appropriate for you, and individual results vary. Nothing here is medical advice.
